When you need to know . . .

Did a throttle system malfunction cause an “uncontrollable
acceleration” leading to this accident?
What was the condition of the throttle system prior to the
accident?
Were both the accelerator and the brakes applied simultaneously
when the accident occurred?
Could this accident be the result of a manufacturer defect or
faulty service/repair work?
Can subrogation be successfully pursued in this case?

Detail of Throttle System Failure
Investigation/ Analysis Service
File review (including examination of police report and vehicle
repair records)
Phone interviews of involved parties (when assigned)
Vehicle inspection:
Remove wheels and inspect brake components
Inspect/test throttle body mechanism
Inspect/test cruise control module and cables
Measure accelerator pedal performance
Electronic scan of PCM and airbag control modules (when
possible)
Test-drive vehicle to determine performance (when possible)
Thorough photo documentation of inspection / investigation
process
Establish proper chain of custody and evidence storage (when
needed)
Coordination and file documentation
Preparation of a fully detailed written report

| The
extremely sophisticated and complex electronic control
systems on today’s vehicles, although highly reliable
most of the time, can fail for a wide variety of
reasons, sometimes leading to a sudden and
uncontrollable acceleration of the vehicle. We can
examine and analyze the vehicle’s throttle system,
including the cruise control electronics, to determine
if the throttle system was functioning properly at the
time of the accident. In many cases, we can also
determine if the brakes and the accelerator were both
applied at the time of the accident (this corroborates
your client’s claim that he/she was pushing hard on the
brakes as the vehicle continued to accelerate
forward/backward). |
